A 15-year-old boy has been charged with the manslaughter of Polish man Arkadiusz Jozwik, who was attacked in Essex in August.
The 39-year-old died after an incident outside shops at The Stow in Harlow.
Initial reports suggested it was being treated as a possible hate crime, but that is no longer believed to be the case.
Mr Jozwik suffered head injuries and died two days later, on 29 August, after being transferred to Addenbrooke's hospital in Cambridge.
In October it was revealed five other youths, who prosecutors said were at the scene, would face no further action due to lack of evidence.
The 15-year-old, who cannot be named for legal reasons, will appear at Chelmsford Youth Court on 6 January.
Paul Scothern, Crown Advocate in the Complex Casework Unit for the Crown Prosecution Service East of England, warned people against posting any information online that could prejudice the case.
"It is very important that there should be no reporting, commentary, or sharing of information online which could in any way prejudice these proceedings," he said.
"For these reasons, it would be inappropriate for me to comment further."
